Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and mytradebuddy, a product of Beluga AI Ltd ("mytradebuddy", "we", "us"), and govern your access to and use of our website at www.mytradebuddy.co, our dashboard at app.mytradebuddy.co, and any related services (collectively, the "Service"). By creating an account, signing an order form, or using the Service you agree to these Terms.

1. The Service

mytradebuddy provides AI-powered growth tools for trade businesses, including an AI receptionist, automated quoting, AI email support, live chat with outbound calling, paid ads with AI lead qualification, a Google review agent, and supporting website and SEO services. We may add, modify, or remove features over time. The specific package, features, and fees that apply to you are those agreed with you when you sign up or accept a quote or order.

2. Eligibility & Accounts

You must be at least 18 years old and authorised to bind the business you represent. You are responsible for keeping your login credentials secure and for all activity that takes place under your account. Notify us immediately at info@mytradebuddy.co if you suspect unauthorised access.

3. Fees, Billing & Refunds

  • Your package and fees are tailored to your business and confirmed with you in a quote or order before you start — there are no hidden charges.
  • The agreed monthly service fee is billed in advance each month in GBP (unless we agree otherwise) and recurs each billing period until you cancel.
  • Your package includes an allowance of call minutes. If you expect to go beyond it, you can buy additional minute bundles in advance, and we aim to flag when you are approaching your allowance. We do not apply separate metered usage charges beyond your package and any bundles you choose to buy.
  • You can cancel at any time. There are no long-term contracts and no cancellation fees — your service continues until the end of your current billing period.
  • Except where required by law, fees already paid are non-refundable.
  • We may change pricing on at least 30 days' written notice. Continued use after the change takes effect constitutes acceptance.

4. Acceptable Use

You agree not to, and not to allow anyone using your account to:

  • Use the Service for unlawful, fraudulent, harassing, or deceptive purposes.
  • Send unsolicited communications in breach of PECR, the UK GDPR, the Telephone Consumer Protection Act, CAN-SPAM, or equivalent laws.
  • Upload customer data you do not have a lawful basis to process.
  • Reverse engineer, scrape, copy, or attempt to derive the source code or models behind the Service.
  • Resell, sublicense, or expose the Service to third parties outside your own business without our written consent.
  • Interfere with the Service's security, integrity, or availability.

5. Your Content & Customer Data

You retain ownership of any data you submit to the Service and any data captured by the Service from your end customers ("Customer Data"). You grant us a worldwide, non-exclusive, royalty-free licence to host, process, transmit, and display Customer Data solely as needed to provide the Service and as set out in our Privacy Policy and Data Processing Agreement.

You warrant that you have all rights and consents necessary to provide that Customer Data to us and that your collection and use complies with applicable law.

6. AI Output

The Service uses artificial intelligence to generate calls, messages, quotes, and other output. AI output is probabilistic and may be inaccurate, incomplete, or unsuitable for a given situation. You are responsible for reviewing AI-generated output before relying on it for business decisions, contracts, or communications with your customers. We do not provide legal, financial, medical, or professional advice through the Service.

7. Intellectual Property

The Service, including all software, models, designs, brand assets, and documentation, is and remains the exclusive property of mytradebuddy and its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription. Feedback you provide may be used by us without obligation. All rights not expressly granted are reserved.

8. Third-Party Services

The Service integrates with third-party tools (for example Google Calendar, Twilio, OpenAI, Stripe, and ad networks). Your use of those tools is governed by their own terms. We are not responsible for the acts or omissions of third-party providers, but we will use reasonable efforts to choose reputable partners.

9. Confidentiality

Each party agrees to protect the other's confidential information with the same care it uses for its own confidential information and at least a reasonable standard of care, and to use confidential information only to perform under these Terms.

10. Warranties & Disclaimers

We will provide the Service with reasonable skill and care. Except as expressly stated in these Terms, the Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific business requirements.

11. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, goodwill, or data, arising out of or in connection with these Terms. Our total aggregate liability under these Terms in any 12-month period will not exceed the fees you paid to us in that period.

Nothing in these Terms limits any liability that cannot be excluded under applicable law, including death or personal injury caused by negligence and fraud.

12. Indemnity

You agree to indemnify and hold mytradebuddy, its officers, employees, and agents harmless from any claim, loss, or expense arising from (a) Customer Data you provide, (b) your breach of these Terms, or (c) your violation of applicable law.

13. Suspension & Termination

You may cancel at any time — there are no long-term contracts or cancellation fees, and your service continues until the end of your current billing period. We may suspend or terminate your account with notice for material breach, non-payment, or where required by law. On termination, your right to use the Service ceases and we will delete or return Customer Data in line with the Data Processing Agreement.

14. Changes to the Terms

We may update these Terms from time to time. Where changes are material we will notify you by email or via the dashboard at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

15. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any dispute, save that we may seek injunctive relief in any competent court.
